USCIS has changed the EB-5 visa inventory process from a first-in, first-out basis to a visa availability approach.

On Wednesday, USCIS announced a process change relating to Form I-526, Immigrant Petition by Alien Investor. The change is to a process that prioritizes petitions from countries where visas are immediately, or soon, available. The substantive requirements for the visa will not change. The new visa availability approach will apply to visas pending as of March 31, when the new process will go into effect. USCIS will hold a public engagement on March 13 at 11:00 a.m. EST to answer questions on the new process.
